Welcome to Cheers Baby Co.! The terms “we”, “us” and “our” refer to Cheers Baby Co. Ltd. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”) in order to provide you with a curated shopping experience. Cheers Baby Co. is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (the “Terms”), describe your rights and responsibilities when you use the Services. By using the Services, you agree to be bound by these Terms and our Privacy Policy.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services you confirm you are 18 years or older, or you have the consent of a parent or legal guardian. You may be asked to provide information such as your email address, billing, payment, and shipping details. You represent that all information you provide is accurate and complete.
You are responsible for keeping your account details secure and for all activity under your account. You may not transfer or sell your account.
SECTION 2 – OUR PRODUCTS
We aim to display products accurately, but colours and appearances may differ on different screens. We do not guarantee products will exactly match images. Descriptions are subject to change without notice. We reserve the right to discontinue products or limit quantities at our discretion.
We supply baby products that include hygiene-sealed components. For safety and hygiene reasons, once a tamper-evident seal is opened, the product is considered used and cannot be returned except where legally required due to a fault.
SECTION 3 – ORDERS
Your order is an offer to buy. Acceptance occurs when we confirm your order and payment is received. We may decline or cancel any order at our discretion and will notify you using the contact details you provide.
Purchases are subject to our Refund & Returns Policy. All purchases are for personal use only; please contact us for wholesale enquiries.
SECTION 4 – PRICES AND BILLING
Prices shown are inclusive of VAT where applicable. Delivery charges and any other costs will be displayed before checkout.
You agree to provide current, complete and accurate payment details. By providing payment details, you confirm you are authorised to use them and agree to pay the full amount including delivery and applicable taxes.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates only but we will make reasonable efforts to meet them. If we arrange delivery, risk remains with us until you receive the goods. Risk and title pass to you on delivery to your address (or to a carrier you appointed).
You are responsible for providing a complete and accurate delivery address. We are not liable for delays or losses caused by incorrect or incomplete address information provided at checkout.
If your order is delayed or lost in transit, you are entitled to a replacement or refund in line with our Shipping Policy and your statutory rights.
Delivery times may be affected by factors outside our control (including courier delays, strikes, adverse weather and peak trading periods). These events may constitute force majeure.
SECTION 6 – CONSUMER CANCELLATION RIGHTS
If you are a consumer, you have a legal right to cancel most online purchases within 14 days after the day you (or someone nominated by you) receives the goods, without giving any reason. To exercise this right, please follow our Returns & Refunds Policy or use the Model Cancellation Form.
Your right to cancel does not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons once the seal has been broken.
This right does not affect your statutory rights in relation to faulty or misdescribed goods.
SECTION 7 – INTELLECTUAL PROPERTY
All trademarks, names, logos, text, graphics, images, video, audio and design are owned by Cheers Baby Co. Ltd or its licensors and protected by UK and international law. You may not reproduce or distribute our content without written consent. You may use our Services only for personal, non-commercial purposes.
SECTION 8 – OPTIONAL TOOLS & THIRD-PARTY LINKS
We may provide access to third-party tools or websites which we do not control. You use these at your own risk and should review the third party’s terms. We are not responsible for third-party content or services.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Cheers Baby Co. is powered by Shopify, but all sales are made directly with Cheers Baby Co. Shopify is not responsible for your purchases. You release Shopify from any claims relating to transactions with us.
SECTION 10 – PRIVACY POLICY
Cheers Baby Co. Ltd is the data controller for personal data processed in connection with the Services. We process data under UK GDPR (contract, legitimate interests, consent for marketing). Shopify acts as our processor and may also act as an independent controller. Please see our Privacy Policy for details of data use, transfers, and your rights under UK GDPR.
Payment data is processed securely by Shopify and its payment partners. Cheers Baby Co. does not store or have access to full payment card details.
SECTION 11 – FEEDBACK
If you provide feedback or reviews, you grant us a licence to use this content for commercial purposes. You represent that you own the rights to such content and it does not infringe third-party rights.
You agree not to submit unlawful, defamatory, obscene, or harmful content. We reserve the right to remove such content at our discretion.
SECTION 12 – ERRORS & OMISSIONS
Occasionally our Services may contain errors, inaccuracies or omissions. We reserve the right to correct these and update information without prior notice, including after an order has been submitted.
SECTION 13 – PROHIBITED USES
You may not use the Services unlawfully or in a way that infringes rights, spreads malware, or abuses others. This includes submitting review or content that impersonates others or misrepresents your identity. You must not attempt to interfere with or bypass any security features of the Services, or attempt to gain unauthorised access to our systems.
We reserve the right to suspend or terminate your account for violations.

We may suspend or terminate your access to the Services at any time. Certain clauses (Intellectual Property, Liability, Indemnity, etc.) survive termination.

We are not liable for misuse of our products or failure to follow safety instructions provided on packaging or on our website.
Subject to the above, our total liability to you shall not exceed the amount you paid for the product.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless Cheers Baby Co. Ltd and our partners, officers, employees and contractors against claims arising from your breach of these Terms or violation of law.
SECTION 18 – SEVERABILITY
If any provision is found unenforceable, the remainder of these Terms remains valid.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce a right does not waive it. These Terms constitute the entire agreement between us and you regarding the Services.
SECTION 20 – ASSIGNMENT
You may not assign these Terms without our consent. We may assign or delegate without consent.
SECTION 21 – GOVERNING LAW
These Terms and any dispute or claim are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in your local UK court.
SECTION 22 – COMPLAINTS & ADR
If you have a complaint, please contact us at support@cheersbabyco.com. If we cannot resolve it, you may use an Alternative Dispute Resolution (ADR) provider. This does not affect your right to go to court.
SECTION 22A – FORCE MAJEURE
We are not liable for delays or failure to perform our obligations due to events outside our reasonable control, including natural disasters, strikes, courier disruptions, epidemics, supply shortages, or failure of third-party service providers. Where such events occur, we will take reasonable steps to minimise disruption.
SECTION 23 – CHANGES TO TERMS
We may update these Terms by posting a revised version on our website. We will notify you of any material changes where required by law. Continued use of the Services constitutes acceptance.
